During the recent unprecedented bushfire season, parts of Victoria and New South Wales were destroyed or heavily damaged, leaving many communities having to rebuild from the ground up in the aftermath. In times like these, portable long service leave isn’t likely to be front-of-mind for those affected.
We’d like to play our part in assisting those who have been impacted in bushfire affected areas* by offering the opportunity for hardship claims to workers and giving special dispensation to employers.
Workers who have been injured or disabled or are suffering emotional or financial hardship due to the bushfires can apply to claim a pro-rata benefit from CoINVEST. This is irrespective of whether they have reached the minimum qualifying period of 7 years continuous service, as long as their most recent recorded service with COINVEST is within the last 4 years prior to 01 February 2020.
We acknowledge that employers in bushfire impacted areas may also be finding it difficult to fulfil their long service leave obligations with CoINVEST. For any employer who is affected by the bushfires and is failing to meet conditions set out in a S10 notice of compliance issued between 01-OCT-19 and 31-DEC-20, any legal action will be withdrawn upon an approved application of hardship.
Additionally, special consideration will be given to any outstanding debt accrued by employers affected by bushfires since 01-OCT-19.
